1. Acceptance and Eligibility

These Terms of Use ("Terms") govern your use of the Emma Color iOS application, website, color-analysis service, recommendations, and AI chat (together, the "Service"). By downloading, purchasing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old. If you are under the age at which you may independently agree to these Terms in your location, your parent or legal guardian must review and accept them for you. A parent or guardian who permits a minor to use Emma Color is responsible for that use.

2. What Emma Color Provides

Emma Color uses photographs and AI-assisted analysis to suggest a color season within the 12-season color system and provide recommendations about palettes, clothing colors, jewelry, and color combinations. Eligible subscribers may also ask follow-up styling questions in an AI chat.

Color analysis and styling are subjective. Results depend on image quality, lighting, camera processing, appearance, and the limitations of automated systems. The Service may produce incomplete, inaccurate, or unsuitable results. Emma Color does not guarantee a particular season classification, appearance, shopping outcome, or level of accuracy.

3. Purchases and Subscriptions

Purchases are offered through Apple's App Store. The price, billing period, introductory offer or trial, renewal terms, taxes, and other purchase details shown in the App Store purchase flow at the time you confirm the transaction are the terms that apply to that purchase.

  • Single analysis. A one-time analysis purchase is a consumable in-app purchase that provides one color analysis. It does not include AI chat access. Once the analysis has been consumed, the purchase may not be restorable or transferable.
  • Subscription. An active subscription provides access to color analyses and AI chat while the subscription remains active. References to "unlimited" use mean ordinary personal use and remain subject to reasonable technical rate limits, availability, safety controls, and protections against automated, excessive, fraudulent, or abusive use.

Subscriptions renew automatically unless canceled in accordance with the terms displayed by Apple. You can manage or cancel a subscription through your Apple ID subscription settings. Billing, cancellation, refunds, and restoration of eligible purchases are administered by Apple and are subject to Apple's applicable rules. Canceling stops future renewal but ordinarily does not retroactively refund the current billing period or immediately end access already purchased, except where required by law or Apple's policies.

4. Your Photos, Messages, and Other Content

You retain any rights you have in photographs, messages, and other content you submit ("User Content"). You give Emma Color a limited, non-exclusive, worldwide, royalty-free license to host, transmit, reproduce, adapt for technical formatting, analyze, and otherwise process User Content only as reasonably necessary to provide, secure, support, and improve the Service, comply with law, and enforce these Terms. This license ends when the content is no longer needed for those purposes, subject to the retention periods described in the Privacy Policy.

You represent that you have the rights and permissions needed to submit User Content. Do not upload photographs of another person without their permission, content that violates privacy or intellectual-property rights, or sensitive information unrelated to the requested styling service.

5. Acceptable Use

You may use Emma Color only for lawful, personal purposes. You must not:

  • submit unlawful, abusive, exploitative, deceptive, infringing, or harmful content;
  • use the Service to identify a person, infer identity, conduct surveillance, or make decisions about health, employment, credit, insurance, housing, education, or other high-impact matters;
  • attempt to bypass purchase checks, rate limits, safety controls, access restrictions, or security measures;
  • reverse engineer, scrape, automate, overload, disrupt, or misuse the Service except where applicable law expressly permits;
  • resell the Service, share subscription access commercially, or use outputs to build or train a competing model or service;
  • use the Service in a way that violates applicable third-party terms, including Apple's or an AI provider's applicable usage policies.

We may limit or suspend access when reasonably necessary to protect the Service or others, investigate abuse, comply with law, or enforce these Terms.

6. AI Outputs and Important Disclaimers

AI-generated outputs may be incorrect, repetitive, incomplete, or similar to content generated for other users. You are responsible for reviewing recommendations and deciding whether to rely on them. Do not treat Emma Color as medical, dermatological, psychological, financial, or other professional advice. The Service does not diagnose skin conditions, health conditions, or personal identity.

Shopping, makeup, jewelry, and outfit recommendations are general styling suggestions. Check materials, allergens, fit, price, return policies, and suitability independently before making a purchase or applying a product.

7. Emma Color Materials

The Service, including its software, design, brand, interfaces, analysis methods, text, graphics, and other materials supplied by Emma Color, is owned by or licensed to Emma Color and is protected by applicable intellectual-property laws. Subject to these Terms, Emma Color grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app and Service for their intended purpose.

8. Third-Party Services

Emma Color relies on third-party platforms and providers, including Apple, RevenueCat, Cloudflare, OpenAI, Amplitude, and Google Firebase. Their services may be governed by separate terms and privacy policies. Emma Color is not responsible for third-party services that are outside our reasonable control. Availability of a provider may affect the availability or performance of Emma Color.

9. Changes, Availability, and Termination

We may add, remove, update, limit, or discontinue features; change supported devices or technical requirements; perform maintenance; or suspend the Service. We will provide notice when required by law. We do not promise that the Service or any particular feature will always be available, uninterrupted, secure, or error-free.

You may stop using Emma Color at any time and delete the app. Deleting the app does not automatically cancel an App Store subscription; you must cancel it through Apple. Sections that by their nature should survive termination, including provisions concerning ownership, disclaimers, liability, and disputes, will survive.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available." Emma Color disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, quiet enjoyment, and any warranty arising from course of dealing or usage of trade. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Emma Color will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, purchases made in reliance on recommendations, loss of data, loss of goodwill, or service interruption arising from or related to the Service. Emma Color's aggregate liability relating to the Service will not exceed the greater of the amount you paid for the Service during the 12 months before the event giving rise to the claim or the minimum amount required by applicable law.

These limitations do not exclude liability that cannot lawfully be excluded or limited, and they do not reduce any mandatory consumer rights.

12. Applicable Law and Disputes

These Terms do not select a particular country's law or require disputes to be heard in a particular court. Applicable law, mandatory consumer protections, jurisdiction, and venue will be determined under the rules that otherwise apply to you and Emma Color. Before filing a formal claim, please contact [email protected] and give us a reasonable opportunity to resolve the issue informally, unless doing so would prejudice your legal rights or a filing deadline.

13. Changes to These Terms

We may update these Terms as Emma Color changes. We will revise the "Last updated" date and provide additional notice when required. Changes apply prospectively from their effective date. If you do not agree to revised Terms, stop using the Service and cancel any subscription through Apple.

14. General and Contact

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be enforced to the greatest extent permitted. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent; Emma Color may assign these Terms as part of a reorganization, financing, sale, or transfer of the Service, subject to applicable law.
